Introduction

Welcome to the Conscious Clinician Collective (“CCC,” “we,” “us,” “our”), a 501(c)(3) nonprofit organization. These Terms and Conditions (“Terms”) govern your membership and use of our platform, including our website, clinician directory, resources, and all related services (collectively, the “Services”). By purchasing a membership, accessing, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

You agree that by downloading, accessing or using any part of the Service, you will be bound by these Terms And Conditions. If you do not agree to these Terms And Conditions, CCC is not willing to grant you any right to use or access the service. In such event, you are not granted permission to access or otherwise use the service and are instructed to exit the service immediately.

1. Membership Eligibility & Requirements

1.1 Eligibility

Membership is available to qualified healthcare professionals including, but not limited to, licensed mental health practitioners, medical doctors, naturopaths, and other healthcare providers who:

  • Hold current and valid professional credentials in their respective fields, students/trainee’s or non-licensed professionals with areas of speciality or expertise
  • Align with our mission of providing ethical, informed, and autonomous care
  • Commit to upholding the Conscious Clinician Compact
  • Adhere to principles of informed consent and medical freedom

1.2 Application and Verification

  • All applicants must complete the membership application process, which includes verification of professional status and current website/contact information.
  • We reserve the right to deny membership to applicants who do not meet our eligibility requirements or whose practices conflict with our mission and values.
  • Existing members may be subject to periodic verification to maintain active status.

2. Membership Terms & Fees

2.1 Membership Overview

  • Membership benefits include:
    • Listing in our searchable clinician directory
    • Networking opportunities with like-minded professionals
    • Access to member-exclusive resources and educational materials
    • Participation in community forums and events
    • Opportunity to contribute to our knowledge base

2.2 Membership Period

Your membership will remain active until it is canceled.
Membership is non-transferable and may not be shared or resold.

3. Payment & Billing

3.1 Payment Processing

All donation payments are processed securely through Stripe.
By submitting payment information, you warrant that you are authorized to use the payment method provided.
You agree to provide accurate and complete billing information.

4. Refund Policy

4.1 Standard Refund Policy

Donations fees are non-refundable, except in cases of:

  • Duplicate payment
  • Technical error resulting in incorrect billing
  • Rejection of membership application (full refund)

4.2 Refund Process

  • To request a refund, contact [email protected] within 14 days of your original transaction.
  • Approved refunds will be returned minus applicable payment processing fees (currently 2.9% + 30¢ per transaction), as Stripe does not return these fees.
  • After 14 days from the original transaction date, all sales are final.

5. Member Conduct & Responsibilities

5.1 Professional Responsibilities

  • Licensed members must maintain current professional licensure and good standing with all relevant regulatory bodies. If no longer operating under a license that must be reported to the public.
  • Members agree to accurately represent their qualifications, credentials, and services.
  • Members commit to upholding the principles outlined in the Conscious Clinician Compact.

5.2 Prohibited Conduct

Members agree not to:

  • Misrepresent their qualifications, experience, or services
  • Engage in discriminatory practices or behaviors
  • Post false, misleading, or deceptive information
  • Use the platform to solicit business unrelated to their professional services
  • Share access credentials with non-members
  • Violate any applicable laws or regulations

6. Directory Listings & Profile Information

6.1 Profile Information

  • Members are responsible for maintaining accurate and up-to-date profile information.
  • Required profile information includes professional credentials, practice information, contact details, and areas of specialization.
  • Optional information may include philosophy of care, approach to treatment, and other relevant professional details.

6.2 Content Guidelines

  • All profile content must be professional, accurate, and in alignment with our mission.
  • We reserve the right to edit or remove content that violates these Terms or is otherwise inappropriate.

6.3 Profile Deactivation

  • You can permanently delete your profile and information from the website on the Manage Profile page. This action cannot be undone.
  • By deleting your account, you acknowledge that no refunds will be issued for any unused subscription time or services.
  • If you choose to re-enroll in the future, you will be required to start a new subscription at the current pricing, with no credits, prorated adjustments, or application of previous payments.

7. Suspension & Termination of Membership

7.1 Grounds for Suspension or Termination

We reserve the right to suspend or terminate membership without refund for:

  • Misrepresentation of qualifications, credentials, or services
  • Loss or suspension of professional license or credentials
  • Violation of these Terms, the Conscious Clinician Compact, or our community standards
  • Conduct deemed harmful, unethical, or misaligned with our mission
  • Failure to maintain accurate profile information
  • Any behavior that compromises the integrity of our platform

7.2 Notification and Appeal

  • Members will be notified via email of any suspension or termination.
  • Appeals may be submitted in writing within 30 days to our review committee.

8. Intellectual Property

8.1 Our Intellectual Property

  • All content provided through our Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of the Conscious Clinician Collective or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.
  • Members may not reproduce, distribute, display, sell, lease, transmit, create derivative works from, translate, modify, reverse-engineer, disassemble, decompile, or otherwise exploit our content without our prior written consent.

8.2 Your Content

  • By submitting content to our platform (including profile information, forum posts, and educational resources), you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, modify, publicly display, reproduce, and distribute such content on our platform.
  • You represent and warrant that you own or control all rights to the content you submit and that such content does not violate these Terms or any applicable laws.

9. Privacy & Data Protection

9.1 Privacy Policy

You acknowledge, and agree that the operation of certain programs, services, tools, options, or information in the Service requires the submission, use and dissemination of various personal identifying information. Accordingly, if You wish to access and use those programs, services, tools, materials, purchase options, or information of the Service, You acknowledge and agree that Your use of the Service will constitute acceptance of the personal identifying information collection and use practices contained in the privacy policies posted on the Service.

9.2 Data Security

  • We implement reasonable security measures to protect member and user information.
  • However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.

10. Disclaimer of Warranties

10.1 Platform “As Is”

  • Our Services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied.
  • We do not warrant that our Services will be uninterrupted, error-free, or secure, or that any defects will be corrected.

10.2 Professional Services Disclaimer

  • We facilitate connections between healthcare professionals and potential clients but do not provide healthcare services directly.
  • We do not endorse, recommend, or guarantee the quality of services provided by members listed in our directory.
  • The inclusion of a provider in the directory does not imply endorsement by CCC. We do not verify or guarantee the accuracy of information submitted by members.
  • Individuals seeking healthcare services should verify credentials and make independent assessments regarding the suitability of any provider.

11. Limitation of Liability

11.1 Scope of Limitation

To the fullest extent permitted by law, the Conscious Clinician Collective shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with our Services.

11.2 Maximum Liability

Our total liability for any claim arising out of or relating to these Terms or our Services shall not exceed the amount paid by you for membership during the 12 months preceding such claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Conscious Clinician Collective, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your professional conduct or services provided to clients found through our platform

13. Modifications To Terms & Services

13.1 Updates to Terms

  • We may modify these Terms at any time by posting the revised Terms on our website.
  • Continued use of our Services after any such changes constitutes your acceptance of the revised Terms.
  • We will make reasonable efforts to notify members of significant changes to these Terms.

13.2 Changes to Services

We reserve the right to modify, suspend, or discontinue any part of our Services at any time without prior notice.
We shall not be liable to you or any third party for any modification, suspension, or discontinuance of Services.

14. Governing Law & Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Pennsylvania, without regard to its conflict of law provisions.

14.2 Dispute Resolution

  • Any dispute arising from or relating to these Terms or our Services shall first be resolved through good faith negotiation.
  • If negotiation fails, the dispute shall be submitted to mediation in Bethlehem, PA under the rules of the American Arbitration Association.
  • If mediation is unsuccessful, the dispute shall be resolved through binding arbitration conducted in Bethlehem, PA.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and the Conscious Clinician Collective concerning your use of our Services.

15.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall remain in full force and effect.

15.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

15.4 Assignment

  • You may not assign these Terms or any rights or obligations hereunder without our prior written consent.
  • We may assign these Terms without restriction.

15.5 Force Majeure

CCC shall not be held liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, war, strikes, epidemics, or governmental restrictions.
